[Craig Seeman] “no punishment I know of.”

Sometimes “punishment” can be fun. Oops. Wrong website!

I don’t mind sending the camera away, or paying the $100 each. What annoys me is the amount of time that they keep the goods.

I think that if you want to put your self out of business, you should implement that strategy tomorrow.

By the way, if you are in a conversation with someone else and you use the line above, you will owe me a “usage fee”.

Seriously though, we have discussed the “ownership” thing many times and it comes down to this when you’re shooting for a client. If it’s not “a contract work for hire”, you would own the copyright (completely useless) because they own the right to use it in perpetuity. This came from the largest IP law firm in Arizona.

  • E-Bay I have bought an incredible amount of good stuff on E-Bay. Haven’t been happy every time but several things have been a steal.

[Todd Terry] “but I’m a Jeep guy. Have been for years and years.”

At least you know in advance which parts are going to fall off. Yeah, I’ve had Jeeps too. They’re kind of like an Audi: Great at first but problems after X number of miles.

Todd, doesn’t your dealer have a recommended leasing company? I know hat some credit uunions have leasing packages as do some banks. The thing to watch out for is the “end deal” which is what takes place when the lease is over.

February 26, 2009 at 9:12 pm in reply to: Talk me down, I’m about to blow a gasket

I have a couple clients on credit card status. They signed a contract that we could charge their company credit card when ever they generated an invoice. So far, so good.

We did a golf product infomercial a few years ago for a 10 year client and he sweet talked my wife into waiting for all of the money at once because of 9-11 and the international transfer of large dollars, etc. We’ve never received a dime and this is after a lawsuit and judgment in our favor.

I have recently suspended almost everyone’ account. Just can’t take the chance any more.

February 25, 2009 at 8:32 pm in reply to: E-Mail etiquette

My wife sent an e-mail to a girl in my office. In her reply, the girl wrote “I resent that e-mail”. My wife was horrified that the girl felt resentment over the original message. A phone conversation followed and the girl was actually saying that she re-sent the e-mail to someone else. Remember “My Cousin Vinny”. Reread your mail before sending and look for ways to ephesize for a correct interpretation on the other end. Punctuation is key.

We also practice this when we put scripts in the prompter.

February 25, 2009 at 8:11 pm in reply to: Question of ethics

OK, let me start over. When we give a client a proposal, most of the time, it is “tiered” to different dollar levels. We put out what they are willing to pay for. If they can’t afford the great stuff, we sell em the good stuff. Fair is fair. You need to discuss this with your employer. Make sure that it’s a fair price for the job being done and the person doing the job. He might be thinking that you are an overachiever and actually feel a bit guilty. On the other hand, he might be thinking that he is getting an incredible deal and plans to keep using you forever.

My car analogy is this: How much do you pay the best Mercedes mechanic in town to change a tire on a 78 junker?

If the application doesn’t match the worker, something needs to be adjusted.

But, as Walter or someone else said, be careful what you post, the COW has zillions of lurkers. Some of the most unlikely people have said to me “Hey, I saw your post on the COW…”.

Hope this cleared up any confusion about my answer.
