They need permission from the distrubutors, which they probably have if they have the videos from them. It’s not the same as needing master and sync licenses becasue your aren’t licensing the music for your own project, they are. Just ask them.

Having these in a commercial would not be fair use.

A did some tv spots for a radio station a few years ago and they supplied me the videos on DVD’s from the distributors. It’s up to the radio stattion to get the clearance, ask them to make sure the videos are okay to use.

    Here’s the spot BTW

If no agreement is in place and the person is not an employee, then the creator of the work owns it, regardless of who’s equipment was used to make the images. The creator is a person, not a peice of gear.

I used to work at a small market TV station doing camera for this exact thing; the local commercials. Yep, sometimes the salesmen would write the scripts and we’d have 30 minutes to shoot and a half day to edit and they looked like crap, but occasionally we got to spend more time on making something look great.

If you can get in the door, try it out, it’s a great way to hone camera skills and you’ll make some good contacts that you can use later in the business.

March 29, 2010 at 4:12 pm in reply to: Green Screen

It’s not hard if it’s lit properly, I have seen many poorly lit green screens that required a lot of work to pull off. One time I had to re-shoot one that was done by a clients internal people because it wasn’t useable.

Light the green screen seperately and evenly, keep the talent away from the bg, put an amber backlight on the talent (or any backlight), it will really help with getting a good key.

Sample I made for clients to undersatnd how we do green screens.

  • I imagine that someone in that industry would understand what he’s talking about.

I haven’t had the issue of a client picking apart a detailed quote, though I think that it may be more information than they need when it’s simply at the quote stage. I think I’ll be changing to this “catch all” type of quoting.

January 22, 2010 at 4:35 pm in reply to: Owning the raw footage

I have always been of the opinion that if I am hired for a shoot, the client is paying for the work, they own that raw footage, that’s the product they are buying from me. If I am editing that footage into something, then they are also buying that from me.

Now, rarely do I get asked for a copy of the raw footage, but I would never use their raw footage for another project without permission, because they hired me, they own it. I always keep a copy of the raw, and I let them know that I ahve a copy should anything ever happen to theirs, they like the redundancy.

I have that clearly said in my contracts.

I’m not sure what you mean about rolling the dice, being dishonest or lying. What’s wrong with releasing new versions? The great thing about forums is that the early adopters take the risk, report on problems and then updates are released.
