Not sure if I read it here, or if someone else told me, but “I never mentioned a figure: first guy that does, loses.” is something I hold on to tight.

Sign the form 1st, then they will open the envelope containing your proposal.
At the time the waiver forms were introduced the explanation I remember was “we get so many ideas sent to us, of course there will be lots just like your already on our desk – because we make a show/series very like yours doesn’t mean we stole your idea – just that we have lots of ideas sent to us and one is bound to be just like yours.”
A flawless argument………….But if you want to play with them you have to play by their rules.

Cold truth is – they don’t.
Once you say “please turn up at this time for the shoot” that is pretty much set in stone – your word is your bond etc. Unless you’re OK paying them twice and re-working your schedule for the next time they are free for a shoot?
The way to deal with it is to build in a back-up plan, in this case someone who can cover your role if you can’t make it.
Chances are the people you want to come in and be filmed will cancel at late notice now and then – but you can’t. Well, not if you want anyone to show up ever again……

Stays the same – unless your contract says otherwise……….
Unless you have some other kind of agreement in place – once you deliver your clip it’s theirs to market as best they can.
Get paid for the work you agreed to – they make a bundle and hire you again to repeat the process.

How valuable is the ambient?
For me in most cases – not very YMMV…….
You have 2 xlr ports right there – can use the “off cam” wirelss for ambient – changing xlr’s mid presentation doesn’t sound good to me, and with only 2 mics that look to be realy important I wouldn’t go for a seperate mixer on something liek this myself.

I might let them off the first time if they looked like life could be good if they used me a lot.
Could invoice them for the kill fee, then discount it off the bottom line as “one time free kill” – reminds them not to do it again and get all grindy on you.

A side note – in many European countries there is no such thing as “Public Domain” in a legal sense.
This doesn’t stop lots of production companies acting like there is – but is worth knowing where you stand before you start.
For example in the UK unless it’s more than 75 years old (need to check that number) pretty much everything belongs to someone, and even when it is old you might get into a Peter Pan situation.
