well, one thing you could probably try (in order to bypass your error messege) would be to export your video without the MPEG2 codec and just use the Microsoft DV compressed AVI (or just a regular AVI if you have the disc space).

But after that, take it into encore and use encore’s encoder (i would suggest the VBR just cause the bit-rate of video does fluctuate.)
