  • Question about selling my raw footage

Posted by Kadshah Nagibe on November 26, 2013 at 11:15 pm

I was recently contacted by and individual who is producing a video for his client. At this time he isn’t interested in licensing footage but he is interested in a acquiring some of my raw footage and retaining the rights to all future usage. I’ve never sold my footage before and so I have no idea on how to go about doing and how to set this up or what to charge. Any input or advice would be greatly appreciated.

That’s called a “buy-out” or “work for hire”. Not uncommon. Unless the footage would be impossible to replicate or is in some other way so unique you’d want to be able to re-sell it over and over, there’s no reason not to sell the rights.

In such a case, figure a decent amount for your expenses and day rate, and a markup for profit margin. I won’t give a firm number, but you could imagine how much it would cost them to get this footage elsewhere, and price yours low enough that it makes more sense to buy it from you.

When you sell it, be sure the deal memo gives you the right to still show sample clips from the footage in the context of your portfolio. demo reel, but you agree you won’t sell it anywhere else.

thanks Mark. Should I expect them to hand me their contract or the other way around?

Better to use your own and have the terms exactly the way you like them. Add-in the cost of the lawyer preparing the document, which is basically a one-time cost, and you can re-use the deal memo for similar future projects.
