Is my Demo Reel covered by fair use? Ex-company claims copyright
Hi there,
Today I received an email from a company that I used to work at, and produced a large number of creative video content with (documentary short and feature). They informed me that I do not have the rights to use their footage or the faces in their productions as their work “is covered under Copyright laws”.
However, I believe my demo reel is under fair use. The video is unmonetized, only 1.5 minutes long (licensed music track background) and is highly transformative in nature as it uses a number of productions in a montage format and is meant to inform people of my camera skills, not to “entertain” as the original companies intention was.
Obviously I should have asked before, but I hadn’t thought to get permission from the company because It was created while I was working there full time.
What are my rights going forward? Am I correct in saying that I am protected under fair use? I am a young cinematographer and don’t have a lot of footage under my belt, taking that footage away from me would really set me back.
Any help would be appreciated.
