Ok, so I have aproject (say 40 seconds long) I export it to live type with a self contained movie. Then within Livetype I place the movie as a background so I can use it to lay down the text in the exact timing with where I want it in the video. Preview the result in LiveType and it looks great perfectly timed etc. then save.

Then I open the IPR Live type file within final cut and the texts are slowly off time and getting worse as it progresses down the timeline. The lenght is now say 35 seconds …. where is the problem, why is the timeing not right or remain as the original when I move back into Final cut.

sounds like you need to make the LiveType project file’s the same fps as your sequence settings… might be a descripancy in frame rate?
