i discovered that when i digitize video from dv and mini dv tape

Yes this is a DVCAM issue. Its the timecode information that normally becomes visible with the underscan switched on the monitor. Also when you preview your settings before encoding this will show on a computer display. You need to crop the top few lines manually. Do this before encoding and you should be OK.
