Ha! My coffee is a little old, but I do usually use the “Recent Project” option. I have gone as far as saving the project to my desktop, making changes, saving, then re=opening the desktop file… Still doesn’t hold the changes…
Thanks

Thanks for the help. This is pretty much how I was going to approach it. The tip about the shadows is a good one, I didn’t even think of that! I will get this setup hopefully this afternoon, and I will definitely post the final result… If it’s worth anything!
Thanks again,

I completely agree with Mark on this one! One of my clients always has massive amounts of type and thirds in their programs… After editing for hours upon end, even going back and reading all of the type out loud isn’t enough to actually “see” some small typos. The client I work with has their own QC department, and I usually just snap a screenshot of every third/text and send it to them in a large zip file. That way the client can zoom through the text and make sure there are no typos and all names/positions are spelled correctly. This saves a ton of time, and work.
If you are concerned about editing mistakes, then someone should watch the entire project. This is what my old manager used to do before we sent anything to the station for air. We would both sit down together and watch the program, this eliminated about 99.99% of any error or typo.
Good luck to you! -

Yes, the client is a production company. The Non-Compete is pretty vague, it states that I cannot take their employees away from them (not a problem). It also states that I cannot create any competing product (again, not planning on it). The non-compete also states that I cannot work with any client/production company/individual/or the like, that creates a product that “company X” considers competition. It’s very vague as to what the “competition” is. Also there is a clause that states any ideas I come up with, or product that I design immediately becomes the property of the company. So it’s a non-compete as well as a “work-for-hire” agreement. Meaning that any and all project files and raw graphics I use, immediately become property of the company.I really do not plan on competing with them, or selling the product that I shoot. I just have a hard time signing something like this. Seems like it takes the “free” outta “freelance”.

I understand that this is a small amount. But at this time, it pays the mortgage/groceries/insurance/etc.As far as your steps are concerned, I am on step two 🙂 I will send a personal letter this week.
Again, thanks for your advice, it is greatly appreciated!

October 13, 2008 at 5:36 pm in reply to: Withholding payment until “Do-Not-Compete” is signedDavid, in response to your direct questions:
1.) This client does owe me a decent amount of money roughly $6,000.
2.) I do care about working with them, but I don’t think this will happen once I refuse to sign.
3.) They cannot justify selling the product, and not paying me, pretty simple.
4.) They can’t justify not paying for good work either. It’s a tricky situation, but I am afraid I will lose this client. I simply cannot sign a Do-Not-Compete. I have a mouth, and it needs feedin’
Thanks again.

Thanks, I am definitely not signing the contract. I completely understand that I pay 15% more taxes, have no insurance, no paid vacation and no 3-5% raise every year for a reason. That reason being that I can approach any client that I feel increases the success of my business. I just needed to know if they were overstepping their legal limitations by essentially forcing me to sign this. I will speak to an attorney if we do not come to an agreement.
I appreciate your advice Walter. -
Great advice David. I never even thought about the aspect of her “testimony” being tainted if she accepted pay, it makes perfect sense. On that note, if she were to donate any pay to a charity helping people like herself, do you think it would still be viewed as “tainted”? I think that it is awesome that she is willing to donate any pay she may receive.
If you are leery about the way in which they may use your interview, why don’t you check out the show. I watched it awhile back, and they seemed to handle touchy situations very well. The topic I watched was on sexual addicts. Every woman was shown in a good light, and it seemed that for the most part their interviews were not edited to say anything other than what they are were trying to get across. You have to watch those producers, they can edit what you say and put it into any context, just watch a reality show. But like I said, after viewing the program, there didn’t seem to be any of that being used in an offensive matter.
Good luck to you, you sound like a good person. I wish you the best in whatever you decide!

Thanks Mitch! just kidding, Mick…
Yes, the economy is killer right now, and if I did not have such a tight niche, with a great client base, I wouldn’t touch this with a ten foot pole. I really appreciate everyone’s help, and I will let you know how it goes. Thanks again!
