    Hey, I know this is not the place to psot this, but don’t really know where else to go, and thought some of you pros might have a quick answer and some wisdom.

    I just discovered that someone is using one of my youtube videos and playing it as part of their TV broadcast (real TV, not web TV). They are playing it right off the internet and incorporating it in an ongoing TV broadcast. Is this legal?

    Copyrights in the news business is a tough area to pursue because “Fair Use” may apply, for example if the footage was used to illustrate a story.

    If they are using footage repeatedly, or if you happened to be in the news business, that may weight in your favor since that would eat into your profit.

    Hey Vince, thanks for your reply. It is not a news story – it is a short, narrative film that I created. And it is being repeatedly used in a TV broadcast format (taken off of youtube) without my permission.

    If the broadcast itself is neither satire or news, you likely would have a good case. Now, you’ll need a lawyer willing to take that case…
