May 23, 2007 at 4:22 pmThe best thing is to use music that you have rights to use, either direct written permission from the artists (say if it is a friend or family member), or pay $$ for the appropriate master/sync license from ASCAP or BMI (or international equilvant).
If you intend to go anywhere with your film even submitting to film festivals they will require documentation proving that you have rights to the music contained in the film.
If this is just background music to paint a scene, it could be anything from just recording someone talking as though they were a DJ, find a friend who knows how to play guitar or piano and record them pounding out some notes. Look around for local musicians that might allow you to use their music. You have lots of legal options.Erik

can I use it in this case? People do this with images all around.

May 23, 2007 at 5:46 pmThat’s a gray enough area that it is probably not worth the risk. By remixing you are creating a derivative work from someone else’s copyrighted material. It may be remixed or altered enough that one might not be able to tell…but there is a chance that someone could charge you with copyright infringement.
That being said, there are artists that are providing music and elements to the public for the express purpose of being remixed into a new work legally. That might be something you might look into.
Check out the Creative Commons website https://creativecommons.org/ for some info. You can also search for music there that you can legally remix and use commercially.Erik
