    I have a client I’m doing a TV commercial for – at the end of the commercial they want to do the following:

    A guy dressed in a fat suit w/biniki, hula dress, wig etc (looks totally ridiculous believe me!) wants to dance to a Shakira song, and is introduced as being Shakira. Obviously it is not.

    Does the use of the music & image fall under Parody here?

    Or should I advise the client that this is a copyright issue and should not be used?

    This is for a local company on local cable.

    ….. I am not a lawyer……Most likely parody , but i would contact my lawyer, small price to pay compared to…..

    I agree that you need to get legal advice on this. My (non-legal) take on it would be that using a Shakira song for commercial purposes without permission would be a clear copyright violation.

    Further, I’d bet that Shakira is unlikely to give permission for anything that would put her in a bad light.

    If you’re using the original Shakira song, there’s no parody – a parody would be a new recording using new, usually satirical lyrics, to the same tune.

    If it’s in a commercial (advertisement), then copyright releases are absolutely required. Parody or not.

    But lets say we have a live show. Its a acrobat performance. Does using a soundtrack as background on a video projection which will be part of the show considered a Copyright violation ??
