  Not FCP but very HECTIC – Lost Shoot Tape

  I know this is not realted to FCP, but one of my editors has lost a clients shoot tape of a gala event before it could be captured.
  Anybody possibly know what the legal ramifications could be? No delivery note was singed, the tapes were just dropped off.

  You cannot imagine how bad i feel. It’s a disaster for my client who is a freelance producer.

  You say the “tapes” but only mention a single tape that was lost.

  Was the missing tape actually delivered with the rest?
  Was it played and checked in your location?

  Who witnessed it being in your location?

  If it was, in fact, AT your location, have you looked:

  A, In tape boxes of other cassettes that may have been open in the same room at the same time?
  B. Call clients who received dubs on the same format tapes as the master?
  C. In the sofa cushions in the room?
  D. In the restroom?
  E. In the coffee area?
  F. In the car of the employee
  G. In the “other pants, back home” of the employee

  There are no limits as to exactly what someone can “claim” in a legal proceeding,
  so its useless to speculate what “might” happen, IF it happens.

  Wow… this is one of those nightmares we all fear.

  Hope you locate the tape.

  As the other post said, you can sue for anything. But assigning a value to a tape will be pretty hard.
  Were there any other shooters at the event? Maybe an audio recording? Any still photographers?
  Is there a participant who can recap on camera the part of the event that was lost, using photos
  of the event or b-roll that your editor *does* have? We had a similar thing happen years ago, where a camera operator mistakenly stopped recording and didn’t realize it. We pieced together all the other
  footage and recreated one small part. No one knew outside the edit suite.
