I think the fact that you have separated your selections within two separate bin windows is preventing the function from working … close the “Audio” bin window/tab and then in the main Browser window use the various bin’s disclosure triangles to view and select from their contents (ie use a hierarchical view in the main Browser window) … now retry the Merge Clips function

when i merge the clips it retains the original audio,
1&2 are my source audio
2&3 are the new merged audiois there anyway to override the 1&2 tracks?
ultimately i am trying to sync audio (from a dual-sync shoot), merge and then
use my different takes in a multiclip…id like to just get rid of the original audio, since its not being used, and makes
the multiclip function a bit messys

The function is strictly a “Merge” one, not a “Replace” one … if Merged clips are not doing it for you then you might want to work with reference movies instead. Creating a reference movie for the purpose you need can be either is a timeline level operation or both browser and timeline level operation. At the timeline level you can manually sync your video and audio clips, delete unnecessary audio, then Export a Quicktime Movie w/ Current Settings but uncheck the Make Self Contained option; or for browser and timeline method, select the two separate video and audio clips to sync in the browser window then chose Make Multiclip Sequnece… again, delete unnecessary audio from the created sequence, Export a Quicktime Movie w/ Current Settings and uncheck the Make Self Contained option. Reimport the newly created movies and use those in place of the original audio and video media … and whatever else you do, don’t delete the original video media as those clips are still being referenced by these new clips!Warning: the timecode on the newly created clips will be the sequence timecode not the original clip timecode … if you need original clip timecode you can manually set the sequence timecode to match, or better still, you can use the Make Multiclip Sequence method described above as that will automatically generate a sequence with timecode that matches the source.
